Rules for the Ferrero National “Divine Taste Experience” Contest (the “Contest”)
*By entering this Contest, participants agree to comply with the official Contest rules as follows:

HOW TO ENTER

  1. This Contest is organized by Ferrero Canada Limited (the "Sponsor"). Contest begins 12:00:01 AM (EST) October 2nd, 2011 and closes on May 31st, 2012 at 11:59:59 PM (EST). There are two phases to the contest. Phase #1: consists of One (1) Grand Prize Draw from all entries received until January 12th, 2012 at 11:59:59pm (EST) and Sixteen (16) Weekly Prize draws that run October 2nd, 2011 until January 12th, 2012 at 11:59:59pm (EST) (“Contest Period”).  Weekly Prize entry also qualifies you for chance to win the Grand Prize. Phase #2: consists of Twenty (20) Weekly Prize draws that run from January 13th, 2012 at 12:00:01 am (EST) until May 31st, 2012 at 11:59:59pm (EST) (“Contest Period”). 
  2. Contest is open to Canadian residents 18 years of age and older as of the start of Contest period. Excluded from eligibility are employees, sales representatives and agents of the Contest Sponsor, its affiliated companies, advertising and promotional agencies as well as all individuals who reside at the same address as the above.

NO PURCHASE NECESSARY TO ENTER:

    1. Visit www.ferrerorocher.ca and complete the on-line entry form, along with your personal information and select submit. Full contest details are available on the site.
    2. On a plain piece of paper print your name, address, telephone number and date of birth and mail in a separate envelope bearing sufficient postage to: Ferrero National Divine Taste Experience Contest, PO Box 246, Dept-FNDTE, Pickering ON L1V 2R4. Mail in entries must be received by 11:59 PM (EST) on Jan 12th, 2012.
    3. Maximum 1 entry per day per household. However, there is a maximum of 10 additional entries per day per household allotted when sending an eCard with the contest entry. eCards must all be sent at one time per day to gain up to the maximum of 10 additional entries.  If it is discovered that a person/household attempted to enter more than once per day by any method all their entries will be void. All persons who live at the same permanent address are considered a household.

 

 

PRIZES for Phase #1:

  1. There is one grand prize available to be won during the Contest Phase #1 period. The grand prize allows Winners to embark on a Divine European Taste Experience for two (2) ARV $20,000. Winners will visit the birth country of Ferrero, as well as experience the many famous foods, fine wines, and beautiful architecture that Europe has to offer. The winners will be free to plan their customized finishing touches to the trip. Travel will be booked at sponsor’s choice, eight (8) night’s, 9 days accommodations at 4-star hotels, based on double occupancy in a standard room. Approximate retail value of Prize is $20,000 based on a Toronto departure and may vary depending on departure city and travel period.

    The European Taste Experience, ARV $11,000, consists of visiting Rome for 1 night, Tuscany for 3 nights, Milan for 1 night, and Paris for 3 nights. The second portion of the trip, ARV $7,000, can be planned by the winner. The second portion of the trip must be taken at the same time as the first planned portion. Winner will be given $2,000.00 CDN for spending money. Below outlines the first two planned portions of the trip:

    1. A Taste of Rome, Tuscany & Italy Experience – 5 nights: Prize includes round trip economy airfare departing from the Canadian International Airport nearest to winner’s home for two (2) arriving by Air Italia in Rome. Travel to Tuscany with its rolling hills, tilted fields, olive groves, vineyards and Medieval hill villages. Activities Include: English-speaking tour through the Chianti Classico area to visit selected wineries with stops to taste the wines and see how they are made. Lunch in a typical Tuscan farm. Cooking lesson to appreciate & learn how to prepare simple food from quality local ingredients. Class will begin in the Mercato Centrale where purveyors provide the best from the Tuscan countryside and continue inside one of Florence’s nicest enotecas. The gastronomic experience will finish with a lovely meal and superb wine. Travel to Milan to depart on to France (part two). Travel will be booked at sponsor’s choice, five (5) night’s accommodations at a 4-star hotel, based on double occupancy in a standard room. Approximate retail value of Prize is $6,000 based on a Toronto departure and may vary depending on departure city and travel period.
    2. A Taste of Paris Experience – 3 nights: This second part of the winner’s planned trip consists of an experience for two (2) people to visit Paris, France. Prize includes round trip departing from Milan, Italy. The three day French vacation focuses on exploring the endless wealth of monuments & architectural treasures, museums, galleries, quaint historic quarters, charming restaurants and cafés of Paris. Includes a tour of Vendome Square and the fantasy of the old Opera House, followed by a drive through the Marais district and its hotels, private townhouses of the nobility of the 17th and 18th centuries. Visit the Latin Quarter with its old Sorbonne University, the Luxembourg Gardens, Saint Germain des Prés with its Romanesque church and famous cafés, before being dropped off near the Orsay Museum for the short boat transfer to the Cité Island. Enjoy a traditional Parisian wine and cheese tasting. Enjoy a guided visit of the interior of Notre Dame Cathedral before returning again by boat to the Louvre Museum & Tuileries Gardens. Discover Paris from the first floor of the Eiffel Tower during a pleasant dinner at the restaurant "Le 58 Tour Eiffel”, followed by a one hour Seine Cruise to admire the monuments and the bridges of the City of Lights. Travel will be booked at sponsor’s choice, three (3) night’s accommodations at a 4-star hotel, based on double occupancy in a standard room. Approximate retail value of prize is $5,000 based on a Milan departure and may vary depending on departure city and travel period.
    3. With the remaining funds, the winners will embark on the remaining half of the trip, itinerary to be planned by winners. Travel will be booked at sponsor’s choice, three (3) night’s accommodations at a 4-star hotel, based on double occupancy in a standard room. Approximate retail value of Prize is $7,000 based on a Paris, France departure and may vary depending on departure city and travel period.

Please note : Should the winner not want to travel to any or all of the locations listed above, then the sponsor and sponsors fulfillment agency will work with winner to arrange for an alternative trip to be taken at equal or lesser value of total ARV prize package for the Ferrero National Divine Taste Experience Contest”.

 

  1. In addition to The Contest Grand Prize, there are sixteen (16) Weekly Secondary Prizes during The Contest Phase #1 to be awarded: One (1) Prize will be awarded weekly, beginning October 2nd, 2011 at 12:00:01am (EST) and ending January 12th, 2012 at 11:59:59pm (EST). Prize consists of a Holiday Hosting Ferrero Gift Basket. Approximate retail value of Prize is $150.00

PRIZES for Phase #2:

  1. There are Twenty (20) Weekly  Prizes awarded during The Contest Phase #2:  One (1) Prize will be awarded weekly, beginning January 13th 2012 and ending May 31st, 2012. Prize consists of a seasonal Ferrero Chocolate Bouquet. Approximate retail value of Prize is $150.00 

PRIZE CONDITIONS

  1. Grand Prize trip must be booked at least twenty-one (21) days in advance of travel, and is based on availability and subject to blackout dates and any other additional restrictions, at Sponsor’s discretion. Trip must be taken within twelve (12) months of the draw date.  Winner is responsible for transportation to and from the departure airport, any items of a personal nature, departure and/or applicable taxes, gratuities, medical insurance, appropriate travel documentation including passport, meals and all other costs not specifically included in the above prize description. The Grand Prize winner and their travel companion must travel on the same route and at the same time.  While best attempts will be made by the Contest fulfillment house to accommodate the winner’s first choice of travel destination, the Sponsor cannot guarantee dates or places requested.

    Prize is not transferable or redeemable for cash, except Sponsor reserves the right in its sole discretion, to substitute the prize or a prize component with one of equal or greater value

 

WINNER SELECTION -  HOW TO CLAIM YOUR PRIZE

  1. A) Weekly Secondary Prizes

    One random draw will be conducted weekly from all entries received within each week’s Contest period until May 31st, 2012 in Whitby, ON at approximately 1:00 p.m. If your entry is chosen, the independent Contest judging organization will contact winner by email or telephone within five (5) days of the draw date. Before being declared a winner, eligible entrant must first correctly answer without assistance, a skill-testing question and complete a signed/returned written declaration and release form, releasing the Sponsor, their respective parties, related affiliated companies, advertising and promotional agencies and employees from any liability in connection with this Contest or prize.  No communication will be entered into except with the selected entrant/potential winner. In the event the selected entrant is disqualified from eligibility, has not correctly answered the mathematical skill-testing question or cannot be contacted by email or telephone within 5 business days of the draw, the independent Contest organization will draw another entrant to be eligible to win a Secondary Prize and the Sponsor shall be fully and completely released and discharged from any liability or responsibility to the first selected entrant(s) in this regard. All decisions of the Sponsor and the independent Contest organization are final.

    B) Grand Prize Vacation for two (2)

    One Grand Prize draw will be conducted on January 13th, 2012 in Whitby, ON at 1:00 pm from all entries received since the start of the Contest period. The independent Contest judging organization will contact winner by email or telephone within five (5) days of the draw date. Before being declared a winner, eligible entrant must first correctly answer without assistance, a skill-testing question and complete a signed/returned written declaration and release form, releasing the Sponsor, their respective parties, related affiliated companies, advertising and promotional agencies and employees from any liability in connection with this Contest or prize. In the event the selected entrant is disqualified from eligibility, has not correctly answered the mathematical skill-testing question or cannot be contacted by email or telephone within 5 business days of the draw, the independent Contest organization will draw another entrant to be eligible to win a Secondary Prize and the Sponsor shall be fully and completely released and discharged from any liability or responsibility to the first selected entrant(s) in this regard. All decisions of the Sponsor and the independent Contest organization are final.
  1. Failure to comply with one of the conditions stated above or any conditions provided in these Contest Rules will result in the person being disqualified and not being entitled to the prize.
  2. Odds of winning a prize depend upon the total number of eligible entries received.

ELEGIBILITY:

  1. This Contest is open to all Canadian residents who are over the age of majority in their province/territory of residence with the exception of employees, representatives and agents of the Sponsor, its affiliated companies, advertising and promotional agencies as well as all individuals who reside at the same address as the above. 

GENERAL RULES

  1. The selected entrant and their travel guest (or their parent/legal guardian if a minor) must sign and return within the time specified a declaration form (administered by mail) releasing the Sponsor, its affiliated companies, their respective advertising and promotional agencies, participating retailers and the independent Contest organization as well as their respective members, administrators, officers, directors, owners, associates, employees, agents, representatives, successors and assigns (collectively, the "Releasees") from any and all liability related to their participation in this Contest and accepting use or misuse of their prize. The Releasees are not responsible for any claim, loss, property damage, expenses or other prejudice arising from this prize, including accidents, injury or death.
  2. By entering the Contest or trying to do so, all persons release the Releasees from any damages, which could arise from their participation or attempt to participate in the Contest.
  3. NOTWITHSTANDING PARAGRAPH 22 by entering this Contest and accepting a prize, the prize winner authorize the Sponsor to use, if required, their name, city of residence, voice, statements, photographs and (or) other image for advertising purposes, without any remuneration whatsoever, unless prohibited by law.
  4. All entries and requests to participate without purchase are subject to verification by the Sponsor. Any entry, which, as the case may be, has been tampered with or is deteriorated, modified, fraudulent, reproduced or obtained illegally will be rejected. Any entry that does not comply with all required conditions will be rejected and will not give right to participation.  Any Contest pieces or other documents, which contain printing or production errors, or any errors, will be void and will not entitle the entrant to a prize.
  5. The Sponsor remains at all time sole owner of the Winning entry and requests for participation without purchase and declaration forms. Declaration forms, entries and requests for participation without purchase will not be returned to contestants. 
  6. No communication will be exchanged with contestants in the context of this Contest, other than with the selected entrant(s). The Sponsor reserves the right to disqualify a person or cancel one or several entries of a person if he/she enters this Contest or tries to do so by any means contrary to these Contest Rules or which would be unfair to the other contestants.
  7. The Contest Sponsor assumes no responsibility for lost, stolen, delayed, damaged, illegible or misdirected entries or submissions that have been submitted through illicit means, or do not conform to or satisfy the Rules or for failure of the website during the Promotional Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion.  The Sponsor reserves the right, in its sole discretion, subject to the approval of the RACJ, to cancel or modify this Contest should a virus, bug or other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws.  Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  The Sponsor is not responsible for any errors or omissions in printing or advertising this Contest.
  8. The Sponsor reserves the right, at it sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part if an event or any human intervention corrupts or affects the administration, security, impartiality or the normal holding of the Contest as provided for in these Contest Rules, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required. In any case, the Sponsor, its affiliated companies, their advertising and promotional agencies, participating retailers, suppliers of prizes, material or services related to this Contest and their employees, agents and representatives will not have to award more prizes than the number of prizes indicated in these Contest Rules or award prizes otherwise than in compliance with these Contest Rules.
  9. For the purpose of these Contest Rules, in event of a dispute, the entrant is the person whose personal information is provided on the on-line entry form or mail-in request. It is to this person to whom the prize will be awarded if he/she is declared a winner. If a dispute arises regarding who submitted an on-line Entry, the Entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
  10. All decisions of the Sponsor or those of its representatives regarding any aspect of this Contest are final and binding, subject to, for the contestants residing in Quebec, any decision by the Régie des alcools, des courses et des jeux du Québec in relation to matters under its jurisdiction.
  11. This Contest is subject to all Federal, Provincial and Municipal laws. Void where prohibited.
  12. Residents of Quebec: Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  13. CONSENT TO USE PERSONAL INFORMATION: When you voluntarily choose to register electronically or by mail to participate in the Contest, personal information including, but not limited to e-mail address, first name, last name, date of birth, city, province/territory, postal code, and home phone number (collectively "Registrant Information") will be collected from you by the Sponsor. SUBJECT TO PARAGRAPH 13 by entering this Contest and providing your Registrant Information, you only consent and agree to: the Sponsors' collection and use of the Registrant Information to administer this Contest, unless you have consented to receive future marketing and promotional information from Ferrero Canada Limited / Ferrero Canada Limited in accordance with Ferrero’s Privacy Policy at www.ferrerorocher.ca.
